Some have called it the worst environmental disaster in the nation's history.  It happened moments after midnight on the morning of March 24th, 1989, as the Exxon Valdez struck Bligh Reef in Prince William Sound.  (The reef was named for the man who later became famous of Captain Bligh of the ill-fated HMAV Bounty.) U.S. National Transportation Safety Board (NTSB) cited probable causes including "fatigue and excessive workload" of the officer at the helm at the time; "impairment from alcohol;" and "the failure of the Exxon Shipping Company to provide sufficient crew for the Exxon Valdez," among other factors. The resulting oil spill blackened some 1,500 miles of Alaska's beaches, according to the AP, which reports that the jury hearing damage claims in the case found in favor of plaintiffs who had alleged that the ship's captain, Joseph Hazelwood, ran the ship into a reef while drunk and Exxon knew he had a drinking problem, but left him in command of tankers." Punitive damages were sought from Exxon, and years of litigation have revolved around how to assess such damages.  For example, Exxon-Mobil's earnings last year were a record 36 billion dollars. Today's ruling, in which two of the three appellate judges concurred and one dissented, cut a previous award of 5 billion dollars in half -- but may have brought closer the day when a final legal resolution of the case can occur. The case is Baker vs. Exxon Mobil Corp., 04-35182.
